What information do I need to provide to the Department of Planning?

  • A letter to the Commissioner of Planning requesting assistance with the sale of the home. Sample letter
  • The name of the housing non-profit agency that may have assisted you when you originally purchased your home or the one that you are currently in contact with.
  • The name, address, and phone number of the prospective purchaser, if applicable. The county will need this information when we verify that the buyer’s income and asset information meet our income eligibility requirements.
  • The name, address and phone number of your attorney and the buyer’s attorney, if available.
  • A copy of the contract of sale prior to its execution and the actual closing for the sale of your home. This contract and the estimated closing date should be provided to the Westchester County Planning Department staff within reasonable time prior to the actual closing date for the sale of the home.

How do I find an eligible buyer when I want to sell my "fair and affordable" home?
Once you have received assistance from the Westchester County Planning Department staff to determine the maximum resale price and the current income limit for the prospective purchaser, you may contact the Westchester Residential Opportunities. If you choose to use the services of a real estate broker, the broker must be advised that the unit is “fair and affordable” and that there are “restrictive covenants” placed on the property. You may also wish to participate in a Homebuyer Fair to obtain more homebuyer assistance information. The Westchester County Planning Department does not maintain a list of buyers.
